This paper undertakes an analysis on the coexistence of two apparently contradictory processes in the contemporary Mexico and their link with the right to health access. The first process referrers to the accomplished advances on the recognition of the denominated “sexual diversity” trough equal marriage and the access to social security, mainly in Mexico City. While the second process analyses the main effects of a health regressive political law, typical of the neoliberal political regimes. Using theoretical tools such as power and heteronomativity, it is discussed the real possibilities that not heterosexual people have to exercise their health access. The critical and radical approaches of the notion “straight mind” permits analyze the objective opportunities to achieve higher levels of health in that population. This text alerts on the risks involved in these processes and it is made emphasis in the particular advances in local contexts that leaves away the global tendencies, which simultaneous existence takes place within an extreme fragility to maintain the recognition for two effects: the normalization character involved in equal marriage access as a structures that legitimize the private property in the market societies while generates a social project highly selective, and on the other hand, the political and economic strengthening that is functional to the conservative and heterosexual moral.
